Terms of services (User Agreement)

This User Agreement (hereinafter referred to as the “Agreement”) governs the relationship between the Academician Shakhmardan Yessenov Scientific and Educational Foundation (hereinafter referred to as the “Foundation” or “Administration”) and an internet user (hereinafter referred to as the “User”) arising from the use of the website yessenovfoundation.org (hereinafter referred to as the “Website”).

1. General Provisions

1.1. The use of the Website materials and services, as well as the completion of any web forms and submission of applications, is governed by the applicable laws of the Republic of Kazakhstan. 1.2. This Agreement constitutes a public offer. By accessing the Website materials or submitting information via feedback forms and application submissions, the User is deemed to have acceded to this Agreement. 1.3. The Website Administration reserves the right to unilaterally amend the terms of this Agreement at any time.

2. Rights and Obligations of the Parties

2.1. The User undertakes to:

  • Provide reliable and up-to-date information when filling out applications, questionnaires, and uploading supporting documents.

  • Refrain from taking actions that may be regarded as disrupting the normal operation of the Website and the Foundation’s services.

  • Not use the Website to distribute malicious software or spam.

2.2. The Administration undertakes to:

  • Ensure the operation of the Website and access to document submission services in accordance with their designated purpose.

  • Ensure the confidentiality and security of personal data and documents uploaded by the User, in accordance with the Privacy Policy.

3. Collection and Processing of Personal Data

3.1. When filling out forms on the Website, the User gives voluntary consent to the collection, processing, storage, and transfer of personal data (including name, contact details, resumes, diplomas, and other uploaded files) for the purpose of reviewing applications and participating in the Foundation’s grant and educational programs. 3.2. The processing of personal data is carried out in strict compliance with the Law of the Republic of Kazakhstan “On Personal Data and Protection Thereof” and the Foundation’s Privacy Policy.

4. Use of Third-Party Services and Cloud Storage

4.1. To ensure secure storage and processing of incoming materials (application files, documents, questionnaires), the Website may use secure third-party integration services and cloud storage (including Google Drive / Google Cloud API services). 4.2. The transfer of files and data to cloud storage is carried out exclusively for technical and operational purposes related to the operation of the Foundation’s programs and grants, without transferring rights to third parties.

5. Limitation of Liability

5.1. All services and materials of the Website are provided on an “as is” basis. The Administration does not guarantee continuous and uninterrupted operation of the Website in the event of technical failures on the side of hosting providers or internet operators. 5.2. The Administration is not responsible for incorrectly specified contact details provided by the User during application submissions.
